The visa subclass 482 is a work visa which was introduced by the Australian Government on 19 March 2019, as a replacement of the 457 visas. This visa allows employers to sponsor skilled workers from overseas in positions where appropriately skilled Australians are not available for work opportunities in their organization. That means a business is allowed to sponsor someone only when they are not able to find a permanent resident or an Australian citizen for doing skilled work.

As per the conditions of the TSS visa, the organization has to be either a Standard Business Sponsor (SBS) or an Overseas Business Sponsor(OBS). The TSS 482 Visa helps to address labor shortages. It can be a pathway to permanent residency.

Temporary Work Visa Subclass 482 Streams

This particular visa has three streams
• The Medium-Term stream
• The Short-Term stream
• The Labor Agreement stream

You need to choose a particular stream as per the Consolidated Skilled Occupations List that is applicable to you. For instance, if the occupation you are eligible for belongs to the short-term category, then your TSS visa will be valid for a maximum period of 2 years. However, it can be renewed from onshore for another 2 years and from offshore for an additional two years. If you meet the Genuine Temporary Entrant requirements and if your occupation belongs to the Medium and Long-Term Strategic Skills List (MLTSSL) or the Regional Occupation List (ROL), then you are eligible for applying the visa for 4 years. Thereafter, you will be eligible for getting a permanent residency after three years provided you meet the age, health, character, and English language requirements.

The labor agreement stream addresses those skill shortages which are not enlisted in CSOL. The employer needs to sign an agreement with the Australian to sponsor an employee in this particular stream.

Things You Can Do With TSS 482 Visa

The Temporary Skill Shortage Visa Subclass 482 allows the holder to work fulltime for the sponsoring company in an occupation temporarily. Dependent family members of the applicant can also be included in the visa application and they can travel to and from Australia till the visa is valid and are permitted to work or study in Australia without limitation.

482 Visa Application Process

The Temporary 482 Visa application is a three-step process.

• The employer lodging a sponsorship application
• The employer lodging a nomination application for a skilled position
• The applicant lodging a visa application

You are supposed to complete the application process in the order as mentioned but it is mandatory for you to wait till each of the applications is granted in order to carry on with the next one.

Requirement For The Applicant For Visa Subclass 482

• Your occupation must be one of those on the list for Consolidated Skilled Occupations
• You have been nominated to work for an Australian employer
• You possess the requisite skills and qualifications needed for your job
• You must have a minimum of 2 years experience in your profession in the last 5 years
• You must possess vocational English language skills
• You must fulfill DHA requirements for health and good character
• In case you are already staying in Australia, you must either have a substantive visa or a bridging visa A, B, or C and that you are compliant with the visa rules.

Requirement For The Employer for Visa 482

• The employer must lawfully operate a business
• The business should have a clear image
• The nominated position for the overseas worker must be fulltime and a genuine one
• Must satisfy the requirements related to salary and employment conditions
• Submit proof of Labour Market Testing if necessary

Requirements For Temporary Visa 482 Holders

• Must continue with health insurance at an adequate level and reciprocal health arrangements may not always be sufficient
• Work only in the position for which the visa has been granted and not work in a different position. A new TSS visa will need to be approved for that.
• Work only for the employer who has nominated you
• Must not stop working for 60 consecutive days. In case you do so, you must consult a lawyer or a registered migration agent for an appropriate solution and potential visa options before you resume work with a different company
• Must possess the license, membership or registration that is compulsory to perform the job for which you have been nominated
• Must be compliant with all the conditions pertaining to the license, membership or registration

TSS Visa 482 – Gateway To PR

1. You work in the same profession and with the same employer on visa subclass 482 for three years
